01What this notice covers
This Consumer Health Data Privacy Notice applies to “consumer health data” as defined by Washington’s My Health My Data Act, Nevada’s consumer health data law, and similar statutes: personal information that identifies your past, present, or future health status. It supplements our Privacy Notice, which covers everything else, and it applies to everyone who uses Maternal Rose, not only residents of those states. Where this notice and the Privacy Notice overlap, the stronger protection applies.
02Health data we collect
In plain wordsEverything on this list exists only because you chose to write it down.
- Pregnancy status and due dates you enter when setting up a child’s story.
- Birth information you record: dates, times, and the events of the day as you tell them in your birth story.
- Health details that appear in what you write: memories and reflections from pregnancy, delivery, and postpartum life, including anything you choose to say about your body, your recovery, or your emotional health.
- Loss-related information, if you choose the compassionate path: that a loss occurred and the timing you share, so the app can respond gently.
- Photos and voice recordings you add that depict or describe any of the above.
We do not collect health data from wearables, health apps, medical providers, data brokers, or anyone else. We do not infer health conditions from your behavior. We do not use advertising identifiers. And we do not use geofencing anywhere, for any purpose.
03Why we collect and use it
Consumer health data is collected and used only to provide what you asked for:
- timing prompts to your stage of pregnancy or your child’s age;
- holding and displaying the stories you write;
- helping you shape your words when you use a writing feature (see the AI section of our Privacy Notice);
- showing your story to the loved ones you explicitly invite;
- producing keepsakes you order; and
- switching to the compassionate path if you tell us of a loss.
We do not collect or use health data for any purpose beyond providing the Service you requested, so no separate consent beyond your choice to use these features is required, and we will ask for explicit consent before ever using it for anything new.
04Where it comes from
From you, when you write, record, or upload it; and occasionally from a loved one you invited, when their perspective or note describes the day. That is the complete list.
06What we never do with it
- Never sold, to anyone, for anything.
- Never shared for advertising or used to target you with anything.
- Never used to train AI models.
- Never disclosed to data brokers or analytics-for-advertising companies.
- Never collected by geofencing; we do not use geofencing at all.
- Never monetized around grief: the pregnancy-loss path, and everything you write within it, will never be sold to you or used to sell to you.
07Your rights
You have the right to:
- know what consumer health data we have about you and receive a copy of it, including a list of the third parties it has been shared with;
- withdraw consent for our collection and use of it at any time, by deleting the relevant content or your account;
- delete it, entry by entry or entirely. Deletion is real: it removes the data from the Service immediately and from backups within 60 days, and we instruct processors to delete their copies; and
- appeal any decision we make about a request, and complain to your state attorney general (for Washington residents, atg.wa.gov) if you are unsatisfied with our answer.
08Exercising your rights
Use the app’s settings, or email privacy@maternalrose.com from your account email address so we can verify it is you. We respond within 45 days, free of charge. If we ever decline a request, we will explain why in writing, and you can appeal by replying; appeals are answered within 45 days by someone other than the person who made the original decision.
09Changes and contact
If our handling of consumer health data changes, this notice and its date will change first, with at least 30 days’ notice by email or in the app before any material change takes effect. The commitments in the section above titled “What we never do with it” are permanent.
