Terms of Service

This is the agreement between you and Maternal Rose. We have kept it in plain language wherever the law allows, because you should not need a lawyer to understand a place you keep your children's stories.

Nothing you write will ever sit next to an advertisement, and nothing you write is ever used to build one.

Never sold

We will never sell your personal information or your content, to anyone, for any reason.

No public feed

Your story is visible only to you and the loved ones you invite by name. There is no discovery, no strangers.

Never hostage

If your subscription ends, everything you wrote stays readable and exportable, free. Paying unlocks tools, never your own words.

01Our promise, and this agreement

In plain wordsThe four promises above are not marketing. They are part of this contract.

Maternal Rose is a private place where a mother keeps the story of each of her children: the birth story, the memories that follow, and the loved ones she invites to read them. These Terms of Service (the “Terms”) are the agreement between you and Maternal Rose, LLC (“Maternal Rose,” “we,” “us”) governing the Maternal Rose mobile apps, the web app, and this website (together, the “Service”). By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Notice and Consumer Health Data Privacy Notice.

Some commitments are so central to what Maternal Rose is that we make them binding here:

  • We will never show advertising inside the Service.
  • We will never sell your personal information or your content, and we will never use your words or photos to advertise anything to anyone.
  • There is no public feed. Your content is visible only to you and the people you explicitly invite.
  • Your words are never held hostage. If your trial or subscription ends, everything you created remains readable and exportable, free of charge, for as long as we operate the Service. A paid plan unlocks tools; it never ransoms what you already wrote.

02Who Maternal Rose is for

In plain wordsMaternal Rose is for adults. Children appear in the stories; they do not use the app.

You must be at least 18 years old to create an account or contribute to one. The Service is designed for parents and guardians recording their own family’s story, and for the adult loved ones they invite. It is not directed to children, and we do not knowingly allow children to use it. If we learn that a child has been using the Service, we will close that access and delete any information the child provided.

The Service is operated from the United States and intended for use there. If you use it from elsewhere, you are responsible for compliance with your local laws, and your information will be processed in the United States as described in our Privacy Notice.

03Your account

You can sign in with an emailed or texted code, a passkey, Google, or Apple, and in some configurations a password. However you sign in, the account is yours alone: keep your sign-in methods to yourself, give us accurate information, and tell us right away at support@maternalrose.com if you believe someone else has gotten in. You are responsible for activity that happens under your account, so guarding access to your email and devices matters.

04The service

The Service includes, depending on your plan and platform:

  • Gentle prompts for capturing memories, tuned to each child’s age and to the level of scripture and prayer you choose.
  • A guided Birth Story experience for each child, with help shaping your raw words.
  • Memories, photos, and voice capture, with recordings turned into text.
  • Story Circles: private, invited spaces where loved ones read along, leave notes of love, and add their own perspectives.
  • Printed keepsakes and store items, when and where offered (see Section 11).

The Service will grow and change. We may add, adjust, or retire features, and we will give you reasonable notice of changes that materially reduce what you are paying for. We may also suspend the Service briefly for maintenance or to protect it.

05Your words are yours

In plain wordsYou own everything you create here. Our license exists so the app can work, and for no other reason.

Everything you put into Maternal Rose, your memories, birth stories, photos, voice recordings, and every word in between (“Your Content”), belongs to you. We claim no ownership of any of it.

So that the Service can function, you grant Maternal Rose a limited, non-exclusive, worldwide, royalty-free license to host, store, back up, reproduce, display, transmit, format, and adapt Your Content, solely to:

  • provide the Service to you and operate its features;
  • show Your Content to the people you have explicitly invited;
  • produce keepsakes you order, such as printed books; and
  • keep the Service safe, for example scanning for unlawful material.

This license does not permit us to use Your Content for advertising, to sell or license it to anyone, or to use it to train generalized artificial intelligence models. The license ends when you delete the content or your account, except for the short period it takes for deletions to clear our backups and for any order already in production to complete.

06Photos, voices, and other people

Stories involve other people: your husband in the delivery room, a grandmother’s voice, a niece in the background of a photo. When you upload content, you confirm that you have the right to share it, including the permission of identifiable people in it. For photos or recordings of children who are not your own, you confirm that you have their parent’s or guardian’s permission.

Loved ones who contribute perspectives or notes keep ownership of their own words and grant the same limited license described in Section 5, so their contribution can live alongside your story.

07Story Circles and perspectives

In plain wordsYou choose every reader by name, and you can change your mind at any time.

Sharing on Maternal Rose happens only through invitations you send: a Story Circle for ongoing reading, or a time-limited perspective link asking someone who was there to add what they remember. There is no way for a stranger to find your story.

  • You control your circles. You decide what is shared and with whom, and you can remove a member or unshare a story at any time, after which they lose access.
  • Invited readers must accept these Terms to participate, and their notes and perspectives must honor the family they have been welcomed into.
  • Perspective links are time-limited and can be revoked. A perspective becomes part of the story it describes and remains under the story owner’s control, including removal.
  • Choose your invitations carefully: an invitation sent to a mistyped email address is still an invitation until you revoke it.

08Help shaping your words

In plain wordsThe words are always yours. The writing tools only help you arrange them, and nothing becomes part of your story until you approve it.

Some features, like the guided Birth Story, polishing a memory, turning a voice recording into text, and asking questions across the stories you can read, use artificial intelligence services to process your words. When you use one of these features, the relevant content is sent to our AI providers (currently Anthropic for writing help and OpenAI for voice transcription) to generate the result. Our agreements with these providers do not permit them to use your content to train their models. See our Privacy Notice for details.

Suggested text can be imperfect: it may misstate a detail or miss the weight of a moment. You review and edit everything, and the final story, including the parts you shaped with these tools, belongs to you as fully as anything you typed by hand.

09Plans, trials, and renewal

Maternal Rose offers two plans, Essential and Premium, each billed monthly or yearly. Yearly plans begin with a 7-day free trial: nothing is charged during the trial, you can cancel any time before it ends, and the subscription begins when it ends. Monthly plans have no trial.

  • Renewal. Plans renew automatically until you cancel. Cancel any time; your plan then runs to the end of the period you paid for. Except where the law requires otherwise, payments are not refunded for partial periods.
  • Billing on the web is handled by Stripe. You can change or cancel your plan in the billing portal inside the app.
  • Billing through the App Store or Google Play, where offered, is handled by Apple or Google under their terms, and cancellations and refunds for those purchases follow their rules and must be managed through them.
  • Price changes will never surprise you: we will tell you before a new price takes effect at your next renewal, with time to cancel first.
  • Free trials are one per person.

10If your subscription ends

In plain wordsEverything you wrote stays yours to read and to take with you, free, always.

When a trial or subscription ends, your account becomes read-only: capturing new memories, the guided Birth Story tools, and sharing tools pause until you subscribe. What never pauses is access to what you already created. You keep free access to read everything you wrote, and free export of your words and photos (Section 15), for as long as we operate the Service. We designed the business so we never have a reason to hold your story for ransom, and this section makes that a promise you can enforce.

11Printed keepsakes and the store

When printed keepsakes and store items are offered, these terms apply to those purchases, which are billed by Stripe separately from any subscription:

  • Made for you. Printed books and other personalized keepsakes are produced one at a time from your story. Your card is charged when production begins, and because no one else could ever buy your book, personalized items cannot be returned or exchanged.
  • If it arrives damaged or flawed, tell us within 14 days of delivery at support@maternalrose.com and we will reprint or refund it. A keepsake should be worthy of what it holds.
  • Proof before print. You approve a preview before a personalized item is produced. Please check names, dates, and words carefully; we print what you approve.
  • Non-personalized items (apparel and other store goods) may be returned unused within 30 days of delivery. You cover return shipping unless the error was ours.
  • Shipping. Delivery dates are estimates. Ownership and risk of loss pass to you on delivery to the carrier, but if a package goes missing, contact us and we will help make it right.
  • Gift cards and gift codes redeem for defined things, such as a year of Maternal Rose or a book credit. They are not cash, hold no monetary balance, are not reloadable or redeemable for cash except where the law requires, and do not expire. Some codes cannot be applied while a subscription billed through Apple or Google is active.
  • Prices for physical goods may change at any time; sales tax is added where required.

12Referrals

When we offer referral rewards, they are for genuinely sharing Maternal Rose with people you know. Self-referrals, bulk or automated invitations, and misleading promotion do not count, and we may withhold or reverse rewards earned that way.

13Acceptable use

Use the Service lawfully, personally, and as it was intended. You agree not to:

  • upload content that is unlawful, infringing, or harmful to a child;
  • use the Service to harass, deceive, or impersonate anyone;
  • probe, overload, scrape, or interfere with the Service, or attempt to access another person’s account or content;
  • reverse engineer the Service except where the law grants that right; or
  • resell the Service or use it to build a competing product.

We may remove unlawful content and may suspend or terminate accounts that violate these Terms. Except where the violation is unlawful content or a threat to others, we will give you notice and a chance to export your content first, because losing a family’s story is not a proportionate punishment for most mistakes.

14Feedback

If you send us ideas or suggestions about the Service, we may use them without restriction or payment. This applies only to feedback about the product, never to Your Content.

15Export and your own copies

In plain wordsYour story should never live only in one place, even ours.

You can obtain a complete export of your words and photos at any time, free, whether or not you are subscribed. Until self-serve export ships in the app, email support@maternalrose.comand we will prepare it for you. We keep redundant backups of the Service, and we still encourage you to keep your own copies of irreplaceable photos; no online service should be anyone’s only copy of something sacred.

16Closing your account

You can delete your account in the app’s settings or by emailing support@maternalrose.com. Because this data is irreplaceable, deletion has a 30-day grace period: if you change your mind, sign back in or contact us within those 30 days and everything will be exactly where you left it. After the grace period, your account and content are permanently deleted, clearing from backups within a further 60 days. We keep only a minimal record that the deletion happened (your email address and the date, so no one can quietly rebuild an account you deleted) and transaction records the law requires us to retain. Orders already in production when you delete your account will still be completed and shipped.

17Our name and our work

The Service itself, its design, software, prompt collections, devotional content, and the Maternal Rose name, logo, and rose mark, belong to Maternal Rose, LLC and are protected by intellectual property laws. We license the Service to you for personal use; we do not transfer any of it to you, and you may not use our name or marks without written permission. Nothing in this section touches Your Content, which is governed by Section 5 alone.

18Copyright complaints

If you believe content on the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act to support@maternalrose.com including: your contact information, a description of the copyrighted work, the location of the allegedly infringing material, a statement of good-faith belief that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and that you are authorized to act, and your physical or electronic signature. We respond to valid notices, accept counter-notices, and close the accounts of repeat infringers.

19App stores and third parties

If you downloaded the app from Apple’s App Store or Google Play, their terms also apply to that download, and this section is for them as much as for you: these Terms are between you and Maternal Rose only. Apple and Google have no obligation to provide maintenance or support for the app, no warranty obligations, and no responsibility for claims relating to the app, including product liability, legal compliance, and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them for the app distributed through the App Store. You represent that you are not in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited parties.

The Service also relies on third-party services (payment, hosting, delivery carriers, and the providers described in our Privacy Notice). We choose them carefully, but we are not responsible for websites and services we do not control.

20Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim warranties of every kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the Service will be uninterrupted or error-free.

Maternal Rose offers encouragement, scripture, and a place to write. It is not medical, mental-health, or pastoral care, and nothing in the Service is a substitute for the counsel of a doctor, therapist, or pastor, especially in pregnancy, postpartum life, and grief.

21Limits on liability

To the fullest extent the law allows, Maternal Rose and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to the Service, and our total liability for all claims will not exceed the greater of the amounts you paid us in the twelve months before the claim or one hundred dollars ($100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. And nothing in this section excuses us from the promises in Section 1.

22Indemnification

If a third party brings a claim against Maternal Rose because of Your Content, your use of the Service in violation of these Terms, or your violation of someone else’s rights, you agree to defend and indemnify us against that claim, including reasonable attorneys’ fees. We will notify you promptly and may participate in the defense with our own counsel.

23Disputes and governing law

In plain wordsTalk to us first. Almost everything can be fixed with an email.

If something goes wrong, write to support@maternalrose.com and give us 60 days to work it out with you informally before filing a claim; most concerns end there.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Claims that survive the informal step must be brought in the state or federal courts located in Delaware, and both of us consent to their jurisdiction, except that either of us may bring an individual claim in small-claims court where you live. To the extent the law allows, both of us agree to bring claims only individually, and not as a plaintiff or class member in any class or representative proceeding.

24Changes to these terms

We may revise these Terms as the Service grows. For material changes we will give you at least 30 days’ notice by email or in the app before they take effect; continuing to use the Service after that date is acceptance of the new Terms. If you do not agree, stop using the Service and export your content; the promises in Section 1 and Section 10 will still be honored for content you created before the change.
